The Wolper Law Firm, P.A. is evaluating allegations made by customers of George John Cairnes (CRD# 4068906), formerly with Wells Fargo Clearing Services, LLC in Houston, Texas. In October 2025, FINRA suspended Cairnes for four months for an undisclosed outside business activity with a firm customer. On July 8, 2026, FINRA suspended him indefinitely for failing to comply with an arbitration award or settlement. FINRA’s September 2026 report spells his name “Carines.”
Broker’s History
According to his FINRA BrokerCheck report, Cairnes entered the industry in 2000 and is not currently registered. His registrations include:
- Chelsea Financial Services (Staten Island, NY), July 2023 to November 2023
- Wells Fargo Clearing Services, LLC (Houston, TX), 2011 to July 2023
- Wells Fargo Investments, LLC (Houston, TX), 2009 to 2011
- Stanford Group Company (Houston, TX), 2008 to 2009
- Merrill Lynch, Pierce, Fenner & Smith Incorporated (Houston, TX), 2000 to 2008
FINRA Suspensions (October 2025 and July 2026)
In an Acceptance, Waiver and Consent dated October 1, 2025, Cairnes consented, without admitting or denying the findings, to findings that he engaged in an outside business activity with a firm customer without prior written notice to his firm. FINRA found that the activity involved an LLC for real estate activities that generated compensation. FINRA also found that he falsely answered firm compliance questionnaires about outside business activities. He was fined $2,500 and suspended from October 6, 2025 through February 5, 2026.
On July 8, 2026, FINRA suspended Cairnes in all capacities under FINRA Rule 9554 for failing to comply with an arbitration award or settlement in FINRA Arbitration No. 24-00971. The suspension continues until the payment is made or discharged.
Texas Order, Termination, and Customer Dispute
BrokerCheck reports an April 2024 Texas order alleging that from May 2015 to April 2023 Cairnes personally benefited from a real estate arrangement in which a client provided all of the financing. According to the order, he identified, bought, sold, and managed properties. He also helped the client open a line of credit secured by the client’s brokerage accounts and received at least $175,000. The order imposed a denial and an undertaking.
Wells Fargo discharged Cairnes in June 2023, reporting that he had facilitated a loan between clients. Wells Fargo also reported that its review found loans and other transactions between a client and individuals associated with him. A pending customer dispute reported in April 2023 alleges that a customer opened a line of credit to lend money to Cairnes, his family, and friends, and that part of it has not been repaid. These are allegations.
Applicable FINRA Rules and Legal Standards
FINRA Rule 3270 requires prior written notice to the firm of any compensated outside business activity. The SEC approved FINRA Rule 3290 on September 15, 2026 to replace it once FINRA sets an effective date. FINRA Rule 3240 generally prohibits a registered person from borrowing from or lending to a customer unless the firm has written procedures allowing it, the arrangement fits an approved category, and the firm is notified and, in most cases, approves. Rule 9554 allows FINRA to suspend a person who fails to pay an arbitration award.
What This Means for Investors
A line of credit secured by brokerage assets can expose a customer to collateral calls and forced liquidation. Customers who borrowed against their accounts to fund a broker’s business or personal needs may have claims. Claims may lie for selling away, misuse of securities-based lending, breach of fiduciary duty, and failure to supervise against the firm. Because Cairnes has not paid an existing award, recovery from the brokerage firm may be especially important.
